WHTQ “Post Summer Ticket” Contest Rules Addendum

These contest rules are specific to the WHTQ Post Summer Ticket Contest (the “Contest”) conducted by NRG Media, LLC d/b/a WHTQ (the “Company” or the “Station”). These rules are intended to supplement the General Contest Rules, however, to the extent that the General Contest Rules differ from these rules, these rules will govern and control with respect to this Contest.  A copy of these specific contest rules and the Station’s General Contest Rules are available at the Station’s studio at 2301 Plover Road, Plover, WI  54467 during normal business hours of 8:00 a.m. to 4:30 p.m., Monday through Friday and on the contest page on the Station’s website at http://www.hot967fm.com/.

When:

The WHTQ “Post Summer Ticket” Contest will run from 09/03/19 through 09/20/19. The winners of the contest will be determined on 09/20/19.

Who Can Enter

To enter, contestants must be residents of the State of Wisconsin, who are 18 years of age or older on or before September 3, 2019.  You can only qualify once, and you can only win the Grand Prize once. Only one winner per household.

How to Play:

Listen to WHTQ during the contest period (09/03/19 -09/19/19) weekdays from 7am – 5pm. WHTQ will announce a keyword and ask you to text the keyword to (715) 345-0967. Text windows will be open for one (1) hour. A reply text will state what time the text window will close.  You can enter to qualify once per number for each keyword. A random text will be picked after each keyword expires, and that listener will become a qualifier in the “Post Summer Ticket” contest. WHTQ will call the qualifier to give them the news that they have qualified.  Message and Data Rates May Apply.

Then on Friday 9/20/19 five (5) qualifiers will be chosen randomly to win the grand prize. Two (2) concert tickets to see Post Malone at the Xcel Energy Center in St. Paul Minneapolis on Thursday, September 26, 2019. The winners will contact by phone between 8-9am and announced on air shortly after.

Due to the time delay that exists between the station’s analog over-the-air single and the station’s online webcast, listeners who listen to the station online may hear it later than those listening to the station’s analog over-the-air single. As a result, the odds of an online listener winning this contest may be diminished.

Grand Prize:

Five (5) Grand Prize will be awarded. Winners will receive two (2) tickets each to the Post Malone concert in Saint Paul, MN on Thursday, September 26, 2019. Winners are responsible for own transportation. The prize winners are responsible for paying all applicable taxes and will be issued an IRS 1099 form. Prize Value: $260.00.

Station reserves the right to substitute a prize of equal or greater value for all contests and giveaways.  Prizes are not redeemable for cash.  No transfer or assignment of prizes is allowed. Station is not responsible for concerts being canceled for whatever reason.

Prizes not claimed within 30 days of being awarded shall be considered forfeited and will become property of the Station.  Such a prize may be disposed of at the discretion of Station Management.

Station and contest sponsors are not responsible for a contestant’s inability to acquire transportation to a location to compete in an event, personal circumstances prohibiting participation in a contest or other circumstances beyond their control. Winners may make no substitution or transfer of prize. Nothing in any contest is intended to create or imply any contractual, fiduciary or other rights for the contestant or obligations, except as expressly stated by Station.

Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited, and anyone behaving in such manner will be disqualified from participating in the contest and asked to leave any event associated with the Contest.

Station acts as an agent only and does not control the various aspects of prize including the concert and is not responsible if any concert is cancelled for any reason.

Winner, on his own behalf and on behalf of Winner’s heirs, successors or assigns, in consideration of participation in a contest, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, does hereby COVENANT TO FULLY RELEASE AND FOREVER DISCHARGE  NRG Media, WHTQ, contest sponsors, and each of their subsidiaries, affiliates, related entities, directors, officers, employees, agents, and representatives, from and against any and all actions, charges, claims, losses, costs, damages, expenses (including attorneys’ fees and expenses) and liabilities of any kind or character, whether known or unknown, in connection with, arising out of or in any way related to Winner’s participation in or winning of any contest and/or acceptance, award, ownership or use of prize after it is awarded.

Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified.

Publicity; Use of Personal Information.
By participating, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, participants agree that the Company may disclose to third parties personal information obtained from participants in the Contest, including but not limited to name and city of residence, and use such information for marketing and other purposes on a worldwide basis in perpetuity.

 

All entry blanks, forms devices and materials, as well as all the information contained on or within, gathered during the course of entry, shall become the sole property of the Company to be used, disposed of or destroyed at the discretion of the Company. Such use may include, but is not limited to, enrolling entrant in one or more of the Company’s listener clubs and sending entrant correspondence and solicitations with regard to such clubs.

Release.
By participating in the Contest, each participant and winner, their  heirs and assigns indemnifies, holds harmless and waives any and all claims of liability against the Company, NRG Media LLC, parent, related, affiliated and subsidiary companies and their employees, agents, members, affiliates, officers, volunteers or sponsors of each, the Contest’s sponsors and their respective employees and agents, for any claim, demand, cause of action, personal injury, death or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Company.

Conduct and Decisions.
By participating in the Contest, participants agree to be bound by the decisions of Company personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited, and anyone behaving in such manner will be disqualified from entering the contest and asked to leave any event associated with the Contest. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and are final. The Company may waive any of these rules or terminate the contest in its sole discretion at any time. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPATE TO THE FULLEST EXTENT PERMITTED BY LAW.

Compliance with Law.
The conduct of the Contest is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein. Station(s) shall follow all applicable federal, state and local laws for conducting contests.
